Guardianship & Conservatorship

A guardianship and conservatorship is a court-supervised proceeding which names an individual or entity to manage the incapacitated person (guardianship) and the affairs of the incapacitated person (conservatorship).  This proceeding is often needed when a special-needs child reaches the age of 18.  An adult may need this protection if he or she becomes disabled or incapacitated and no power of attorney or trust has been executed by this individual prior to incapacity.  This proceeding may also be used for seniors who are the target of elder abuse even though the individual may have a valid power of attorney.
