Estate planning is the preservation and distribution of your assets, during your life and upon your death.  A good estate plan will protect you and your family in case of temporary or permanent incapacity and organizes a smooth transfer of wealth upon your death.  Yahne Miorini counsels clients with modest to multi-million-dollar estates including non-U.S. citizens with overseas assets.  A standard estate plan includes the preparation of the following documents:

  • General Durable Power of Attorney (financial power) and Limited Power of Attorney (when necessary)
  • Advance Medical Directive (medical power) with a Living Will
  • HIPAA Release (medical information release)
  • Last Will and Testament (sometimes combined with a Revocable Trust)
  • Tangible Personal Property Directive
  • Funeral Instructions (optional)

Advanced Estate Planning

There are many well-established strategies that can reduce or eliminate estate taxes, but you must carry out the planning process while you are alive and have the mental capacity to do so in order to implement these plans.  

You need to be aware that many states have separate estate and inheritance taxes as well as assets protection standards.  If you own property in more than one state, your taxable estate may be subject to the taxes of more than one state.
