A guardianship and conservatorship is a court-supervised proceeding which names an individual or entity to manage the incapacitated person (guardianship) and the affairs of the incapacitated person (conservatorship). This proceeding is often needed when a special-needs child reaches the age of 18. An adult may need this protection when the adult becomes disabled or incapacitated and no power of attorney or trust has been executed by this individual prior to incapacity. This proceeding may also be used for seniors who are the target of elder abuse even though the individual may have a valid power of attorney in place.
We will assist you through the entire process from assessing the need of a guardianship and conservatorship, the selection and appointment of a guardian and conservator, guidance on the guardian and conservator of their legal duties, and the preparation of the initial inventory and ongoing accounting reports.
